• The Minister of Transport has dismissed the appeals of Gray's Luxury Coaches against the decisions of the Scottish Traffic Commissioners refusing to grant it a licence for express carriage services between Carnock and Lyle and Scott's factory, Rosyth, and between Ballingry and the factory. Instead the Commissioners granted a licence for stage carriage services to W. Alexander and Sons (Fyfe) Ltd.
The Minister found no sufficient grounds for differing from either decision.
The services proposed by Gray's were of the "assisted, travel" type. The respondents proposed to run stage services at ordinary fares, which the employers (Lyle and Scott) would wholly or partly refund to the workers on a similar basis to the proposal with Gray's.
The Minister found no conclusive evidence that operation by either firm would involve employers or workers in greater or lesser costs—she agreed with the Inspector in disregarding statements made at the appeal inquiry on this point.
The Minister accepted the respondent's position as the regular operator of stage services in the area was a factor to be taken into account, as well as the appellant's position as the previous provider of through services to the factory. The case was a closely balanced one.
