Evidence was given by Geoffrey Allen, chairman of the company, that they had begun to have doubts about the profitability of the TIR business and in April 1978, called in a consultant. As a result of his report, a decision was taken to wind up a subsidiary company which had undertaken the maintenance of the vehicles and to appoint a general manager to take charge of both the UK and TIER departments.

In October the company became worried about the financial situation in the TIR department and, although he had earlier been given assurances, -Mr Green was made redundant.

The Tribunal said that there was no prior consultation with Mr Green or his union and he was dismissed instantly. The company claimed that this was so that he could have every opportunity of finding suitable alternative employment.

The Tribunal felt that the company had acted rather hastily and in view of Mr Green's long service, it might have been more considerate to let him have time to clear up his office.

Although accepting there was no customary arrangement or agreed procedure in relation to redundancy, the Tribunal felt the company ought to have told Mr Green and given him the opportunity of having a union representative present. None of this would have made any difference said the Tribunal, as they were satisfied that there was indeed a redundancy situation.
