E Transport Tribunal in London on Tuesday dismissed an appeal against the decision of the North Western deputy Licensing Authority granting a new A licence for two tippers for a period of two years to Mr. Leslie Owen, trading as Mark Owen, of Parr Stocks Road, St. Helens, Lancashire.
The appeal was lodged by the Transport Holding Company (British Road Services) who claimed that the application for the new licence heard in Liverpool on November 24 was made in the wrong traffic area because the bricks and brick-making material to be carried by the tippers would be transported from Warwick to all points over the country except within the North Western traffic area.
Mr. J. S. Lawton, for British Road Services, said that if the Tribunal accepted
that the application to transport bricks from the Napton (near Rugby) factory of the Allied Brick and Tile Co. was made correctly in the right traffic area, then the evidence produced at the hearing was applicable only to a B licence application and not to an A licence.
"It is a curious appeal because you will find in the transcript of the lower hearing that the applicant describes his application as a reluctant one and said that if it were not granted no hardship would be incurred by him. This point was made constantly throughout the lower hearing that the applicant did not really want the application and that it was if anything an embarrassment to him", said Mr. Lawton.
