OVERTEME worked by two lorry drivers should not be taken into account in calculating their redundancy pay, three judges ruled in the High Court on Monday.

Appeals by Mr. John Herbert William Pearson, 62, of Cowper Close, Bromley, and Mr. Ronald Arthur Workman, 34, of Chipperfield Road, St. Paul's Cray, Orpington, against a decision of the Industrial Tribunal, sitting in London, were dismissed by Lord Parker (Lord Chief Justice), Mr. Justice Waller and Mr. Justice Swanwick in the Queen's Bench.

The Tribunal had upheld the redundancy pay awarded to the two drivers by their former employers, William Jones Ltd., of Charlton SE, being based on a 40-hour working week.

Mr. Justice Waller, giving judgment, said any overtime worked by the two men was in accordance with the national agreement made between the Engineering Employers' Confederation and the Confederation of Shipbuilding and Engineering Unions.
