You cannot be compelled to reinstate your driver but you might find the refusal expensive. From June 1, 1976, the Employment Protection Act empowers the Industrial Tribunal to make an order for reinstatement or re-employment at its discretion. Refusal to comply with the order could result in increased compensation for the dismissed employee up to a maximum of about £12,000.
