Conduct for Hauliers

A CODE of conduct for long-distance hauliers was approved last week by the national executive committee and the national council of the Road Haulage Association.. They also agreed t3 the reconstitution of the long-distance hauliers committee as a functional group.

It was decided that the chairmen of the clearing house group and of the new long-distance hauliers' group should discuss between them a proposal for the licensing of clearing houses.

Machinery for the enforcement of the

code has been established. Arbitration on any dispute over the meaning of the code will be by three members of the committee of the group, whose decision will be binding. The main provisions are; Rates paid shall be those generally recognized As fair for the traffic and destination, and shall be shown in a confirmation note in a •sealed envelope to be handed to the driver at the time the collection notes are received, or posted to the carrier not later than 24 hours after load has been collected.

Save in exceptional circumstances, commission deducted on account of sub-contracting shall not exceed II) per cent, of the rate charged by the main contractor to the ttader, whether the traffic is obtained direct from the trader or not, Where ancillary services are provided for the sub-contractor they should be itemized and the charges should be reasonable.

Accounts shall be settled by end of aext month following receipt of invoice and supporting documents. Members shall not solicit traffic previously carried on behalf of another haulier member of the Association or accept any such traffic at a lower rate than the prime rate to the trader.

Traffic shall be sub-contracted on the terms of the current R.H.A, conditions of carriage, but every sub-contractor shall be entitled to have the benefit of any term in the contract for carriage of the traffic, as between the trader and the main contractor, which is more favourable to the subcontractor than the provision in that respect of the R.H.A. conditions of carriage. That concession applies only to the particular transaction.

Members who are convicted of persistent and flagrant breaches of statutory regulations may be tieated as having broken the code. "Main contractor" means the haulage contractor who contracts direct with the trader

for the carriage of traffic. " Trader " is the person who has contracted with the main contractor for the carriage of traffic, but he must not be engaged in carrying or arranging for the carriage of goods for hire Or reward. "Prime rate" means the rate charged by the main contractor to the trader before deduction of cash or any other discount.,
