Which of the following most accurately describes the problem?

• A driver sacked by Beecroft Transport after he refused to accept a change in employment terms has been awarded £3,035 compensation for unfair dismissal by a Hull Industrial Tribunal.

Malcolm Potter was employed by Beecroft for nine years. In August, the company wrote to its drivers detailing changes in the terms and conditions of employment, to be implemented three days later. The changes were not favourable to the drivers and overtime rates were altered.

Potter refused to accept the changes and he, together with other trade union members, requested a meeting with management to resolve the matter. Their request was refused by the company.

On 22 August, Potter having made it clear that he refused to accept the changes in the terms and conditions, refused to work on the following Saturday until overtime rates were reviewed and improved. On the next Saturday he was dismissed.

The Tribunal said Potter was unfairly dismissed as the company's actions gave him three days notice of unfavourable changes. The way Potter was dismissed was also criticised.
