AN appeal by Ribble Motor Services, Ltd. North Western Road Car Co., Ltd., and Birmingham and Midland Motor Omnibus Co. Ltd., against the refusal of the West Midland Licensing Authority, to allow them to run a joint direct Birmingham-Glasgow service has been dismissed with costs by the Minister of Transport. The case was heard before Mr. E. C. P. Lascelles, and the Railway Executive and Northern Roadways, Ltd., appeared as respondents. Northern Roadways, Ltd., as reported on page 246, has had its licence for a similar service revoked.

The appellants claimed to be the existing operators on the route, the needs of which they recognized. They made no application to run a' direct servicebecause they felt restricted by Orders protecting rail facilities.

For. Northern Roadways, Ltd., Mr. F. A. Stockdale said that the Minister had made it clear that the extent of road facilities might be varied if the railways failed to provide a reasonable and sufficient, service. The principle of preference for existing operators was not recognized in the 1930 Act and had not been laid down in a reported ease. Mr. Lascelles observed that there was a demand for a road service because the fares were lower than those of rail, but he could not recommend that it be augmented until the Authority had had an opportunity to consider .proposals from the appellants about revising the timings. of the existing facilities to provide greater convenience for the travelling•public.

IN London, on Tuesday afternoon, the I Transport Arbitration Tribunal approved agreements between the Road Haulage. Executive and 12 'hauliers, involving the payment of £768,299 compensation.
