Mr. Brian I. Lewis, of Grange Farm, Wraxall Road, Warmley, Bristol, had applied for renewal of his B licence covering 11 vehicles, with two modifications, including one additional vehicle.

Replying to Mr. W. M. Huntley, appearing on his behalf, Mr. Lewis said the breach of suspension arose during December of last year. The vehicle concerned had been suspended for seven days with effect from December 8 because of lack of maintenance and on the last day before the suspension began it had been loaded at Frome, Somerset, with hardcore for delivery to the south coast.

In fact, it never got there because of a severe snowstorm and only succeeded in returning to Wallinley under difficult condi tions by using a different route. It arrived back at the base at 6.30 p.m.

In the meantime, said Mr. Lewis, a message was received from the customer, requesting the load to be re-delivered to Bath, a distance of some four miles. The next morning, when the suspension was due to come into operation, it was found impossible to transfer the load because it was frozen solid. "In those circumstances I sent the vehicle to Bath on the Saturday morning, contrary to the suspension order," he said. "It was on the road for about 2+ hours."

Mr. Samuel-Gibbon, the Western LA, said: "I can grant the renewal of the existing 11 vehicles, but I cannot deal with this matter without taking some notice of the fact that a vehicle was used while under suspension. I will delay the grant in respect of the additional vehicle for 14 days, to take effect from May 14, 1968."
