Which of the following most accurately describes the problem?

Please advise me upon the following :—I am a haulier running a 30-cwt. Bedford. 1 have a contract with the local council for the collection of house refuse and have had it since 1928. I have to employ a man to empty the dustbins into my lorry on four days per week. Am I bound to pay him the rate of wages as laid down by the Road Haulage Central Wages Board ? If 1 have to pay him the wages as mentioned would it be in order to pay him wages suitable to the type of work he would be doing on the other two days of the week ? I am operating under a B licence.

As you are operating your vehicle under a B licence, it appears that the man comes under the provisions of the first paragraph in the Third Schedule to the Road Haulage Wages Act, wherein it is laid down that a road haulage worker means a person who is employed . . . ". . . collecting or loading goods to be carried in or on the vehicle . . . unloading or delivering goods after being so carried . . . and who is required to travel on or accompany the vehicle for the purpose of doing any such work . ." In the circumstcmces, the man would appear to come under the category of "mate" and require to be paid accordingly. It will be in order to pay him wages suitable to the type of work he is doing on the days of the week when he is not occupied as above.
