• A condition imposed on the licence of Norman Mager, of East Halton near Grimsby when local residents complained, has been altered by North Eastern Deputy Licensing Authority Norman Moody, because it could cost Mager a third of his business.

Mager, who holds a licence specifying 12 vehicles and 24 trailers with seven vehicles and nine trailers to be acquired, appeared at a Hull public inquiry last week to explain the impact on his business of a condition that prevented engines being run and vehicles leaving his operating centre before 07:00hrs.

The DLA was told that the condition as it stood was totally impracticable. Steel was collected from Immingham Docks for delivery in the Birmingham area between 08:00 and 09:00hrs for three major customers, and it would be impossible to meet the delivery times if vehicles could not leave before 07:00hrs. Although he had carried for the customers concerned for the 20 years he had been in business, and despite the fact they did not want to lose his service, they had indicated that they would have to find other hauliers if he could not meet the delivery schedule.

Mager produced figures from his accountant, showing that the three customers concerned were responsible for around 50% of the business's profit, saying that he would have to sack drivers if he lost their work.

After hearing evidence from one of the customer's concerned, Moody altered the condition so that it prohibited engines being run and vehicles leaving before 06:00hrs.
