Which of the following most accurately describes the problem?

Overloading, a defective speed limiter and a defective tachograph have together cost a Northern Irish haulier £785 in fines and costs. Crossinglen-based Alex

Johnston, trading as Johnston International, admitted the offences before the Leyland. Lancashire, magistrates.

Prosecuting for the VI. John Heaton said that in November a Scania artic belonghg to Johnston was stopped and its permitted gross weight of 17,000kg was found to be exceeded by 3,520kg, or some 20.71%.

The driver's tachograph charts showed that the speed limiter was not working. The tachograph dil switch settings had been

altered so that speeds were recorded which were 6km., h slower than the actual.

The driver said that he did not load the vehicle, that he had not weighed it before starting his journey from Bromborough, and that it was not his usual vehicle.

When interviewed Johnston said the vehicle had been tested at the Newry Test Centre four weeks before and that it had been mechanically and legally sound when it left the yard.

The driver had been previously warned when the tacho had been recalibrated about tampering with the equipment. He was not allowed near the vehicle during loading for hygiene reasons and there was no facility at the load* point to check axle weights.

In &Ligation, the magistrates heard that the

overloading offence was a matter of distr bution—the truck hadn't been load+ beyond its design weight It had been load+ using a calculation for another vehicle hi there were no safety implications. Tampa ing by a driver had caused the tacho ai speed limiter offences, but it was uncle which driver. The magistrates heard thi Johnston was also in financial difficulty.

Fining Johnston. the magistrati accepted that the vehicle had been check+ before the offences and no faults found.
