THE action against six members of the executive council of the Transport and General Workers' Union and the London Transport Executive, alleging conspiracy, wrongful dismissal and breach of contract, which was down for hearing last Monday, was postponed until February 27 on the application of counsel for two of the defendants, Mr. M. R. Nicholas.

He applied for a stay of hearing on the ground that two of the members of the executive council of the T.G.W.U. were standing as Parliamentary candidates.

Mr. Astell Burt, for the plaintiffs, opposed the application, and said that he had searched the lists of Conservative, Liberal and Labour candidates, but had failed to find the names of the two defendants. He later withdrew his objection,

The plaintiff, Mr. Rice, is a member of the National Passenger Workers' Union, and refused to resign from his Union and join the T.G.W.U. while an employee, of the London Transport. As a consequence, he was dismissed. . The two defendants concerned no longer hold office on the executive of the T.G.W.U.
