Which of the following most accurately describes the problem?

• "rhe international licence held by Derbyshire hauliers David Mellor has been renewed without restriction by Eastern Licensing Authority John Mervyn-Pugh, despite complaints of noise nuisance from local residents.

The company had sought renewal for 13 vehicles and 14 trailers, with 10 vehicles and trailers based at a new operating centre on the Ashbourne Industrial Estate and three vehicles and four trailers at its existing operating centre at Buxton Road, Ashbourne.

The LA refused to consider objections to the use of the latter site from Derbyshire County Council and West Derbyshire District Council on the grounds that he could not consider a lack of planning.

Director David Mellor said that he also ran a commercial vehicle repair business from the Buxton Road site. If he was forced to keep all his vehicles on the industrial estate they would still be serviced and maintained at Buxton Road.

Granting an unrestricted five-year licence MervynPugh said that in the circumstances he did not propose to impose any conditions.
