drivers were cleared of an alleged 1.46% axle overload after Huddersfield magistrates were told that the overloading had been caused by surge.
The prosecution said that when the company's rigid tanker, loaded with black oil, was checked on the Aimley Top dynamic axle weighbridge there was an overload of 890kg on the second axle.
Defending, Michael Paterson said that a gross overload of 250kg is within the tolerances of plus or minus 150kg per axle when using dynamic axle weighers.
If the vehicle was within its legally permitted gross weight then the only possible explanation for such an overload on the second axle was that the oil had surged backwards and then forwards as the loaded vehicle was driven over the weighbearn.
