Which of the following most accurately describes the problem?

• Renewal of the North Eastern Licence of Transfleet Services which organises 100 vehicles and 64 trailers has been refused because the company failed to advertise correctly in a vehicle newspaper.

The advertisement described the application to operate from depots at Morley, Halifax and Rotherham a being a renewal without change whereas, pointed out North Eastern Licensing Authority Frederick Whalley, the Halifax premises had not been previously used.

For Transfleet it was argued that, though not strictly accurate, the advertisement had achieved the desired objective in that it had attracted 146 representations on environmental grounds against the use of the Halifax premises. It was unlikely that anyone had been prejudiced.

Refusing renewal, Whalley said he thought that the advertisement could have misled potential objectors and representatives. If the company were to submit ail application for a new licence properly advertised he would be preared to grant intrim authority to enable it to continue operations from Morley and Rotherham.
