Which of the following most accurately describes the problem?

• The licence held by Currie's Transport Services (Dumfries) has been renewed without restriction by Scottish Licensing Authority Hugh McNamara — despite representations on environmental grounds from four local residents.

The company had applied to renew its licence from an operating at Heathall Dumfries for 10 vehicles and 60 trailers in possession with 14 vehicles and 50 trailers to be acquired. Residents wanted renewal to be refused on the grounds that the access road was totally unsuitable for use by heavy goods vehicles. They maintained it was narrow and that Curries vehicles constituted a danger to children.

Evidence was given, however, that there had only been three accidents in the area in the last 10 years and none of those had involved children. A representative of the highway authority said it had no objection to the use of Currie's operating centre.

Granting renewal in full, McNamara said that the residents had failed to prove their case.
