Which of the following most accurately describes the problem?

BRITISH Railways, Scottish Region, had been operating vehicles on a licence although an appeal against the grant of that licence had not yet been heard, the Transport Tribunal was told when the hearing of the appeal began in Edinburgh this week.

The Scottish LA, Mr. A. Bimie, issued licence discs to British Railways for 16 maximumcapacity vehicles which he granted in Edinburgh in November 1966, said Mr. J. A. Murray, appearing for the eight appellants.

He asked the Tribunal to rule that the LA should not have done so until the appeal had been resolved and that in so doing he had acted in breach of Section 176 of the 1960 Act.

Mr. Murray also suggested that British Railways were operating illegally and he asked the Transport Tribunal so to rule. The president, Mr. G. D. Squibb, took the view that the Tribunal were not the competent body to deal with such situations.

Mr. Murray stressed the point that British Railways representatives had produced figures at the inquiry which showed that since the Freightliner service began from Glasgow, railways traffic had increased by only six per cent.

Mr. Murray drew particular attention to the evidence given by Mr. Aitken, British Railways terminals and cartage manager, Glasgow division, in which he stated that 66 per cent of the total Freightliner traffic had previously been moved by road.

The hearing continues.
