Which of the following most accurately describes the problem?

v PPING magistrates decided • last

week that an ex-W.D. vehicle fitted with a breakdown crane was a dualpurpose vehicle and not a motor tractor, and therefore subject to a 30 M.p.h. speed limit, rather than 20 m.p.h.

Frank Henry .Woollard, 182 High Road, North Weald, was stopped by the pialice for speeding. The police told him he was exceeding his permitted 20 m.p.h. and he replied that he thought he was allowed to travel at 30 m.p.h.

Woollard pleaded not guilty to a charge of exceeding 20 m.p.h., and for the police, Mr. A. H. Lewin said that most of the available loading space of the vehicle was taken up by a crane. He stated: "The question is whether the vehicle was built for the conveyance of goods of any description. . . . If it was not, you may be satisfied that it is a tractor."

Mr. Lewin conceded that the vehicle was originally allowed to travel at 30 m.p.h.,but he contended that regard must he had to its construction at the time of the alleged offence.

The manager of the Potter Street garage of the London Co-operative Society, Ltd., owners of the vehicle; said that for 75 per cent. of its time the vehicle was used to carry goods.

The chairman inspected the vehicle, which was loaded with cases, carboys and other goods, and found that at the time of the alleged offence it was not used as a tractor. The summons was dismissed.
