Which of the following most accurately describes the problem?

A PEDESTRIAN who caused a J n. Dundee Corporation bus to brake suddenly to a halt was successfully sued last week by an injured.passenger at Dundee Sheriff Court.

The passenger,. Mrs. Helen Petrie, 72 Alloway Terrace, Dundee, was thrown from her seat when the bus braked. She sued both the corporation and the pedestrian, Mrs. Norah Ogg, 38 Forfar Road, Dundee.

Sheriff McKinnon held that the driver had to make an emergency stop. Evidence that the horn was sounded showed that Mrs. Ogg could not have been paying attention. He found that the mishap was caused entirely by the pedestrian and exonerated the corporation. Mrs. Ogg was found liable for the damages claimed, £19 10s., plus expenses.
