m The decision of Bolton magistrates to fine HM Commercials just £100 for using a vehicle without an 0licence has been attacked by North Eastern Deputy TC Mark Hinchliffe.
Saying that such a fine had no deterrent effect. Hinchliffe said that, although he was unaware of evidence given to the magistrates, it ought to be indicated to them that the purpose of the 0-licensing system is to support and regulate the haulage industry; to promote high standards of vehicle maintenance; and prevent extreme danger to the public.
The Deputy TC refused to grant HM Commercials a new national licence for 10 vehicles and 35 trailers after being told that the company had operated without an 0-licence since January 1998. He said the company had put vehicles on the road which on occasion were in poor condition; displayed 0-licence discs they had no right to display or no licence discs at all; and were driven by drivers who were likely to be tired because they were not complying with the hours rules.
