Leighton Buzzard based John Hobbs has lost his appeal against the refusal of Easte n Deputy Traffic Commissioner Brian Horner to allow him to base three vehicles and a trailer at Berkhamstead.

Hobbs trades as Hemel Reproductions with a licence for three vehicles. He wanted to base the vehicles at Lower Little Heath, Little Heath Lane, Potten End: this plan was opposed by Hertfordshire County Council and a number of residents.

The Tribunal heard that little Heath Lane was a narrow lane and access to the proposed operating centre was on the apex of a right-angled bend.

The Deputy TC refused the application because the entry and exit was dangerous and there would be adverse environmental effects.

Fred Randall, for Hobbs, argued that the Deputy TC should have called for road safety evidence from a traffic examiner. He said the visibility standards at the site complied with planning policy guidelines.

Dismissing the appeal, the Tribunal said road safety was the subject of comment by almost every witness and there was ample evidence for the Deputy TC to make his findings. He was entitled to come to the conclusions he had.
