The new statutory offence of corporate manslaughter • The offence applies to corporations including limited companies (however small), local authorities, NHS trusts and some government departments.
• It does not apply to individuals, sole traders or partnerships except limited liability partnerships.
• Common-law manslaughter is abolished for companies.
• Proceedings cannot be instituted without the consent of the Director of Public Prosecutions.
An organisation will be guilty of the new offence if: The way in which its activities are managed or organised by its senior managers a) causes a person's death, and b) amounts to a gross breach of a relevant duty of care owed by the organisation to the deceased.
Penalties are fines, not imprisonment.
