his claim that he was sacked after refusing to drive an unsafe truck. Michael Okey, 37, claimed constructive dismissal from his employer Lister Carter, of CJE Transport, Pocklington, North Yorks, on health and safety grounds.

He alleged the 38-tanner he was driving had a string of faults which made it dangerous. But a Hull industrial tribunal found that Okey, of Priestgate, Nafferton, near Driffield, had resigned of his own accord.

The tribunal heard that defect report sheets made no reference to faults which Okey claimed made the vehicle unsafe to drive.

Okey said the windscreen was cracked and exhaust fumes were entering the cab, making him drowsy and nauseous. He accepted that the aileged faults might not have been illegal, but insisted they interfered with safe driving. He is considering an appeal.
