Mayor for overloading a 7.5-tormer has been quashed on appeal, but an appeal by driver David Cowley against his £200 fine was rejected.
Both had pleaded guilty before Leyland magistrates to breaking the permitted gross weight of the vehicle by 11% and the back axle by 12%.
Preston Crown Court substituted the £500 fine for each offence with absolute discharges. But the judge said that the driver had been fully responsible for failing to look at a weighbridge ticket he had been given at Preston docks after picking up a load of palletised bitumen. The judge ordered him to pay £35 costs.
