my mechanic, who was out on pre-MOT test on a vehicle and was stopped by the police, is now being prosecuted for no MOT certificate on the vehicle.
I do not think I was out of order. What is your opinion?
As far as can be seen there is no exemption for a vehicle used in this way. It must have a test certificate in just the same way as if it had been fully licensed.
When a vehicle is actually undergoing an MoT test then a test certificate is not necessary. But this does not seem to have been the position in your case.
