The LA, states the judgment, took the previous conduct of the respondent into account, observing that in all ordinary circumstances operations without a licence are sufficient to disqualify an applicant and that the respondent had continued to operate illegally in spite of warning. Nevertheless, he had come to the conclusion that it would be in the public interest to allow the respondent to operate under the protection of a licence.
