Which of the following most accurately describes the problem?

do.nn &:-• A TOTAL OF 331 Norbert Dentressangle (ND) employees arc set to transfer under TUVE regulations to First Quench Retailing (FOR), following the drinks supplier's decision to take its logistics operations back in-house.

FOR has confirmed that it is terminating its five-year transportation and warehousing contract with ND from September, although it only began in March 2008.

An ND spokeswoman says: "The contract, which is based at our site in Dunstable, employs 331 people across the warehousing and transport operations.

-We believe the warehousing operation will be taken in-house and the transport transferred to a thirdparty provider. TUPE transfer regulations will, therefore. apply."

FOR says it has decided to bring operations in-house as part of a turnaround programme that will enable the business to further hone and develop a bespoke and highly flexible function.

The company which operates 1,400 Threshers: The Local and Wine Rack stores, says it is working closely with ND on the exit management plan of the 331 affected staff. FOR recently issued a "going concernwarning, citing a -material uncertainty" that cast significant doubt on its ability to continue trading, according to accounts filed at Companies House this month. For the period from 16 May 2007-28 June 2008, the group made a pre-tax loss of £30m.

-FOR is facing issues at this challenging time, and we understand these contribute to the reasons for the change of supply solution. We arc working with the firms to ensure the smooth transfer of the operation," the ND spokeswoman concludes.

• An interview with Stuart Lloyd, sales and marketing director at ND's transport division, will appear in a future issue of CNL
