• PE & PM Burton (Sheepskins) based in Storridge, \Vans has been cleared of using a vehicle in which the tachograph had not been the subject of a two-yearly check.

The company denied the offence before Llandrindod Wells magistrates and statements were read to the court that when police officers stopped the vehicle there was no evidence that the tachograph had been checked in the preceding two years.

Defending, Jonathan Lawton said that when interviewed, the company was not asked when the tachograph had last been checked. The company had been charged under Section 97(1)(b) of the 1968 Transport Act. That section was directed at a failure to repair a tachograph. There was nothing in the evidence to suggest that the tachograph in this case had needed, or had in fact been, repaired.

The magistrates ordered defence costs to be paid out of public funds.
