Which of the following most accurately describes the problem?

• Swedishowned Europa Flier was granted a licence for six vehicles and trailers when it appeared before South Eastern and Metropolitan LA Brigadier Michael Turner at a Westminster public inquiry.

The company had applied for a new licence based at Brent Park, London, after losing the use of its operating centre at Witham, in the Eastern Traffic Area.

Turner said that according to his information none of the four vehicles it was currently author ised to operate on interim licence had been taxed since the end of August 1991 or had been tested since early 1991.

For the company, Stephen Kirkbright said that it was a subsidiary of Europa Flier AB. It specialised in the transport of air freight and it had a large contract with Transpeed at West Thurrock. Its operations in the UK had been controlled by a Mr JC Tinworth.

However, a dispute developed with Tinworth in December 1990 and various legal proceedings were taken and threatened.

Its vehicles were regularly stopped by the police, though no proceedings had ever been taken against the company.

As a consequence, the Swedish managing director, Bo Nielsen, instructed that none of the vehicles should enter the UK.

Producing records showing that none of the vehicles had been in this country since July 1991, Kirkbright said that in such circumstances they had not needed to be taxed or tested.

Granting the licence, Brigadier Turner said that he wanted audited accounts produced as soon after the year end as possible.

He also wanted the tachograph and maintenance records from the beginning of August until the beginning of December sent to the nearest test station so that he could ensure the company's new system was working properly.
