Which of the following most accurately describes the problem?

TRAFFIC Commissioners for the South Eastern Traffic Area have decided not to revoke the psv operator's licence held by Southampton operator Coliseum Coaches following convictions of the company and 11 of its drivers for over 200 driver's hours and tachograph offences.

The Commissioners took into account the good repute of the company for over 30 years. They noted that under the 1980 Transport Act they only had the choice of licence revocation or nothing; they had no power to take any less drastic action such as curtailment of the licence on the basis of the convictions. This to them seemed a gap in the legislation.
