• The West Midland LA. Mr John Else; indicated at a public inquiry in Birmingham last week that he would examine the circumstances in which several drivers employed by the same firm were granted hgv licences when another of the firm's drivers, Mr Edward John Darby, was refused a similar application.

Mr Else heard that the company, Merseyside Car Deliveries, Birmingham, had supplied several drixers with letters confirming they had driven heavy goods vehicles over a six-month period during the 12-month statutory period ending February 1970 which makes drivers eligible to receive an hgv licence without taking the appropriate driving test. However, Mr Darby had been refused such a letter.

Mr Darby who had unsuccessfully appealed to the LA against the decision to refuse his hgv licence application, claimed that if he was not eligible to receive a licence then neither were the other drivers as they had been engaged on similar work during the statutory period.

He went on to say that he had been a heavy goods driver for more than 20 years and it was just unfortunate that in the 12-month period he had not been employed driving heavy vehicles as much as usual.

On refusing the appeal Mr Else said: "Although you may be an experienced heavy goods vehicle driver you do not come within the requirements of the legislation".
