Douglas Hutsby was said to live on a farm with a supply of red diesel which is restricted to farm tractors and other agricultural vehicles.

The diesel fine was revealed when Hutsby, of Holloway Farm. Wasperton, near Stratford-uponAvon, appeared at Stratford Magistrate's Court to answer charges of using a truck and trailer without the appropriate licence.

Bill Hutchinson, prosecuting for Vosa, said the licence offence came to light during a routine inspection of Hutsby's vehicle as he drove on a road near Learnington, Warks.

Hutsby told the magistrates his business earned 05,000 a year from which he drew a salary of £12.000. He apologised for the licence offence, was fined £120 and received three penalty points.

However, Hutchinson revealed that Hutsby had also been lined on the spot at the time of the inspection for using red diesel instead of legal fuel. "The £1,000 fine was imposed by HM Revenue and Customs which was working with me at the time," Hutchinson told the court.

• At least six operators have been charged for delivering goods to Welleshourne Market, near Stratford, without 0-licences. In addition some of the drivers did not have the appropriate vocational licences. The charges follow a swoop by Vosa officials on vehicles servicing the market'.

The operators will appear at Stratford-upon-Avon Magistrate's Court over the next few weeks.
