Which of the following most accurately describes the problem?

• jacksons Express Deliveries Ltd have been successful in a bid to increase their fleet following an agreement with objectors Cheshire County Council and Macclesfield Borough Council.

The company, of Gaw Lane End, Macclesfield, had applied to North Western Licensing Authority Roy Hutchings to add five vehicles to its fourvehicle national licence.

For the company John Backhouse said that agreement had been reached with the objectors. The company had planning consent to operate up to six vehicles. No vehicles over 16 tonnes gross were operated and no maintenance was carried out at the operating centre.

The councils were concerned about the damage to the road surface. The company would be happy to accept a restriction that no vehicle over 16 tonnes gross be operated and to limit its application to four additional vehicles without prejudice to the planning consent. That meant that if it wished to operate all eight vehicles it would have to make a planning application. The bulk of the vehicles left at 0600hrs and had returned by 1900hrs though there were two occasions on a Friday when vehicles left as early as 0400hrs.

Granting the application as agreed Hutchings indicated that he would impose conditions restricting the hours of operation to between 0600 and 1900hrs with the exception that on one day a week vehicles may leave as early as 0400hrs.
