Case.

An Industrial Tribunal i Edinburgh heard that when h became unfit for normal drivin duties, Mr Gilmour was offere alternative employment as conductor but refused.

His psv licence was restricte to the driving of semi-automat vehicles and since manw gearboxes would be used fc some time to come, .Easter Scottish indicated it wa impracticable to employ such driver.

Two hours before his cas was due to be heard, Mr Gun our asked for a postponemer and this was granted. The di • fendants asked for expenses this time, which was deferre until the next hearing.

Prior to this Mr Gilmot. stated that he felt his cas wasn't strong enough and th hearing was cancelled.

The defendants agai claimed expenses and said thi one of their inspectors had see Mr Gilmour driving a minibus t which he replied he was simpl testing a bus for a prospectiv employer and claimed to be sti unemployed.

The Tribunal ruled that th application had been trivial an the reason for the postponemer quite insufficient, putting th defendants to needless troubl and expense. They awarde Eastern Scottish £50 expenses
