THE QUESTION as to' whether a new stage carriage type city bus will have to be fitted with a tachograph is worrying many operators.
According to the letter of the law, passenger vehicles built to carry more than fifteen passengers need a tachograph, except when it is on a regular service of up to 50km.
So a psv being delivered from factory to operator could only require a tachograph for the delivery journey (even if running on trade plates).
The current practice is for operators to arrange tachograph calibration and even if the tachograph was fitted from the start of manufacture it would be uncalibrated so the driver would still need to use an individual record book.
The industry will have to wait for a test case to be brought before the courts to see just how the regulations are to be interpreted.
