Doyle, of Stockport Road West, Lower Bredbury, Stockport, pleaded guilty to 21 charges before Macclesfield magistrates.

The magistrates fined Doyle £560, ordered him to pay £120 prosecution costs and endorsed his driving licence with four penalty points for driving without an LGV licence.

His employer Greens Transport of Ashton under Lyne is accused of three overloading offences and two of permitting Doyle to drive without an LGV licence.

Prosecuting for the Department of Transport, John Heaton said Doyle's vehicle had been stopped in a check. The vehicle was weighed and found to be overloaded by 1,380kg on the first axle, by 22.62%; 1,460kg on the second axle, 1 4 . 2 5 % ; and 2,840kg in excess of the gross weight, 17%. The overload was considerable and must have been apparent to the driver, he said.

An examination of Doyle's tachograph charts revealed some offences. Further charts were obtained from the company and a total of 383km was not accounted for.

Inquiries showed no record of Doyle holding an LGV driving licence. Greens Transport could not find a record of having seen a licence. When interviewed, Doyle had said he did not know where his LGV licence was. He later admitted that he was not a holder of an LGV licence. He had said he had asked Greens for a job and he had got one. Greens had not asked for his LGV licence. Later, the new transport manager asked him to produce his licence. Doyle told him he had lost his licence and heard nothing further from the company.

Doyle said that he had not fully understood the law regarding tachographs. He had passed the PSV driving test and he had been under the impression that he could drive LGVs.

The case against the company was adjourned until May.
