Which of the following most accurately describes the problem?

WESTERN DEPUTY trafic commissioner (DTC) Fiona Harrington has revoked the O-licence of a Gloucestershire operator who transferred vehicles to his son’s business without telling her ofice.

At a public inquiry in Bristol, the DTC was told how Stroud-based sole trader Edward Sutton, trading as John Sutton Building Contractors, passed ownership of three trucks to Sutton Skips, run by Sean Sutton, without authorisation.

Sean told Harrington he would “urgently remedy” the situation by submitting an application for an interim and O-licence in his name.

The DTC said she believed the error had been an oversight and not wilful or with malintent. “I accept the operator did not understand – but ought to have known – that transfer of the business previously carried out by him and changes in the person owning and operating the vehicles, is a material change in circumstances that requires notiication to the TC.”
