Which of the following most accurately describes the problem?

• The High Court has overturned Bristol Crown Court's decision to refuse costs to Wilfred Holden (Blackburn) after the company had succeeded in getting overloading fines reduced. Mr Justice Popplewell said that where a less severe sentence had been imposed on appeal such a costs order should normally follow.

No jurisdiction

• Allegations that BJG Transport (Scotland) failed to ensure a driver handed in tachograph charts within 21 days, and that driver Arvid Andersen failed to hand them in, have been dropped. Defence solicitor John Backhouse pointed out that Lancaster magistrates had no jurisdiction to hear the charges because the offences would have been committed in Scotland.

Formal warning

• Scottish TC Michael Betts has issued a formal warning to George Brebner, trading as Brebner Carriers of Fraserburgh, about his future maintenance standards and the recording of convictions. But Betts took no action against the licence.

Licence lost

• The licence held by Aberdeen haulier William Cressy, who traded as Dyce Haulage, has been revoked on financial grounds by Scottish TC Michael Betts. Cressy appeared before the Commissioner at an Aberdeen public inquiry.
