• IN ADJOURNING disciplinary proceedings involving Richard L Spooner, trading as R L Spooner Wholesale, of Derrington, near Stafford, for one month to enable a vehicle examiner to carry out a maintenance investigation, West Midland Deputy LA Roger Seymour emphasised the importance of operators keeping appointments with vehicle examiners.

The LA said Spooner's licence had been renewed in July 1988. On September 12 a vehicle examiner reported that he had been unable to establish what the maintenance arrangements were, that no inspection records were available, and that attempts to contact Spooner and discuss the situation with him had been unsuccessful.

Ann Spooner said her husband had been unable to attend as he was unwell. It was only a small business. They had been running two vehicles at the time and making an appointment for the vehicle examiner to see them meant losing a full days work.

They had had difficulty in making convenient arrangements and when the vehicle examiner arrived no one was there, said Ann Spooner. It was a cash-and-carry business and the records were locked away. The vehicle found to be defective was disposed of straightaway. It had been into the commercial garage undertaking the maintenance three days previously, and they had given the garage carte blanche to put things right. As a result, they had changed the commercial garage that they were using. At the moment they had just got the one vehicle, which was on hire, and they had a Mercedes on order.

The Deputy LA said that if Spooner did not comply with his obligations as a licence holder he would eventually lose his licence. He was still not satisfied about the fact the vehicles were not made available to the vehicle examiner.

Mrs Spooner had said that they had had the vehicles available on three occasions, scrapping everything, but the vehicle examiner had been unable to keep the appointments because he was on holiday.

Adjourning the hearing, the Deputy LA said the vehicles would have to be made available for the vehicle examiner to carry out the necessary inspection If that was inconvenient, said the Deputy LA, he was sorry, but it was the Spooner's responsibility.
