Which of the following most accurately describes the problem?

THE Transport Tribunal has partly granted the appeal of Sunter Bros. Ltd., Pickfords Ltd. and others against the Yorkshire deputy Licensing Authority's decision to grant a 12-ton low-loader to Baynards (Excavations) Ltd.

Baynards were operating the vehicle on a C licence and the grant was made on the submission that there was spare capacity which could be usefully applied if the B licence were granted. The Tribunal held it was undesirable in the public interest that the low-loader should travel one way empty if that made it necessary for another haulier's vehicle to travel the other way empty. While it was felt that such occasions were infrequent, the matter had to receive consideration.

The members came to the conclusion that in the circumstances justice would be done to both parties by varying Baynards' B licence by adding to it: "A tractor and lowloader trailer subject to the condition— road construction and other items of machinery to or from any road or civil-engineering site from or to which the licensees are collecting or delivering their own plant within a radius of 60 miles of Helperly (York) Post Office." To this extent the appeal was granted.
