Gain Damages of £1,097 DAMAGES and costs amounting to £1,097 10s. in a breach of contract case, involving the transport of 290 vehicle radiators in October, 1957, were awarded against Andy's Transport, Ltd., Southam Road, Banbury, in the High Court, on Tuesday.

Mr. Justice Hilbery held that they should indemnify A. C. Denton and Co., Ltd., Elephant Lane,, Bermondsey, London, S.E.16, hauliers, who had contracted with them to carry the goods from Whitfield, Braekley, Northants, to Belvedere, Kent.

He said that during their carriage the radiators had shifted and a large number of them had fallen into the road because of -insecurepacking. All were so badly

damaged that they were unfit for resale.

Andy's Transport, who denied liability, claimed that they were told they would be collecting scrap radiators, which did not imply care in loading. The judge said that he was quite satisfied that Dentons never indicated that. There was no reason why they should do so as the goods were coming to them for export packing.

Earlier Mr. Justice Hilbery had given judgment for C. and R. Motors, Ltd., Parkhouse Street, Camberwell, London, S.E.5, importers and exporters of vehicles and spares, against Dentons, for breach of contract regarding the transport of the goods. Dentons conceded the damage.
