Which of the following most accurately describes the problem?

• Failing to appear at a public inquiry in Cheltenham this week was a contributory factor .t'o the surrender of 0 licences belonging to two operators. Mr B. P. Uatherley, of Leckhampton, and Mr J. Mudden, of English Bicknor, were called to appear before the Western LA, Mr J. R. C. Samuel-Gibbon, under Section 69 of the Transport Act 1968, for non-payment of licence fees. The LA stated that in both cases the operators concerned had previously held C licences and applications for 0 licences had been made after the transitional period, as provided by Section 94 of the Act.

Their applications had been approved and requests made for the appropriate fee but despite this no fees had been received at the Western traffic area office. Mr Samuel-Gibbon said that in view of the hauliers' non-attendance, the grants made would now be treated as surrendered and if they wished to operate vehicles they would have to start again as new applicants. A different decision might have been possible had the operators attended the inquiry and stated they intended to pay the fees.

It is understood that the cases will now be handed over to the enforcement section for appropriate action because now the operators have no authority to use the vehicles.
