OVERLOADING a vehicle carrying baking materials cost John and Anne Gardner, trading as lain Gardner, and driver James McDougall, £310 in fines and costs, when they appeared before Rochdale magistrates, The court was told that when the vehicle was stopped in a weight check the train weight exceeded that permitted by 1,850kg, an overload of some 4.8%. McDougall had said that he had not loaded the vehicle, and had picked up the trailer from a colleague.

In mitigation, it was said that another driver had picked the trailer up after it had been loaded by the customer, The Gardners had been advised of the weight of the load, but it subsequently transpired that the weight of the pallets had not been included. The first driver had thought that the weight was accurate and, when driving the vehicle, had no reason to suspect that it was overloaded. The trailer was then swopped on to McDougall's tractive unit.

The partners were each fined £100 and McDougall £50. All three were ordered to pay £20 each towards the costs of the prosecution.
