Which of the following most accurately describes the problem?

• Willenhallbased Ruby Transport and one of its drivers, were ordered to pay fines and costs totalling 22,570, after admitting a series of drivers' hours and tachograph offences at Rochdale Magistrates.

Driver Derek Harrison, of Walsall, pleaded guilty to six offences including exceeding 41/2 hours driving without taking a 45 minute break; failing to operate the mode switch of his tachograph; and exceeding the daily driving limit. He was fined 2770, plus 250 costs. Ruby Transport pleaded guilty to permitting Harrison to exceed 41/2 hours driving without the required amount of break; two offences of failing to get him to operate the tachograph mode switch; and two of failing to ensure he handed in his tachograph charts within 21 days. The company was fined 21,700, plus 250 costs.

Defending, John Backhouse (left) said following the offences, the company had spent 25,000 on a computer system to check charts and had employed someone to operate it.

Harrison had taken breaks, but had not spread them out in the right amounts said Backhouse. The prosecution said it would not proceed on a large number of other apparent offences committed by Harrison as he had pleaded guilty to sample offences.
