BRS SOU II lERN has lost an appeal against limits imposed On its Canterbury depot, but the Transport Tribunal has given Licensing Authorities more guidance on how to handle such cases in future.
BRS wanted to move its operations to Roadline UK's depot in the city (CM, July 20, 1985), but South-Eastern LA Randall Thornton limited the licence on environmental grounds.
He reduced the application from 30 vehicles and seven trailers to 12 vehicles and six trailers, and that only on condition that Roadline reduced the number of vehicles on its licence to seven or fewer vehicles.
And he restricted the depot to a daytime operation with no more than six maximum weight tractive units.
lie dismissed BRS's appeal in total, including its assertion that Thornton should not have made the grant conditional on Roadline applying to reduce the number of vehicles on its licence.
But to guide LAs in future cases of this nature, the Tribunal says they should offer to adjourn an application to enable changes to be made to the application, if the operator agrees, or to grant a shortterm licence to establish whether the operator's intentions are put into effect.
