Which of the following most accurately describes the problem?

THE Court f.Appeal gave judgment, on January 31:all-Owing the appeal by the West • Midland: Licensing Authority, Col.' A.. S. Redman, from the judgment of a Divisional Court quashing the Authority's decision to grant a B licence to Hill and Long. Ltd., to carry furniture and household goods outside the area for Which the company bad . applied—Birmingham and Wolverhampton--on the ground that he had no jurisdiction to do so.

Lord Justice Greer said the licence granted was one which the authority had the power to grant. What the respondents, the Great Western Railway Co., had obtained in the Court below was a revision of the Act limit lag the kinds of application to be made by treating them as applications for a particular 'district.

That was not what the Act provided for, and, whilst he had some sympathy for the railway company, he -thought it was unreasonable to impose such a restriction on a concern of furniture removers. But he considered that the railway company was sufficiently protected by the fact that the licence operated only for a year.

" Lords justices Slesser and Roche concurred and the appeal was allowed with costs. Leave to appeal to the House of Lords was granted.

The proceedings on January 30 were reported in last week's issue.
