Which of the following most accurately describes the problem?

• Sunderlandbased haulier Anthony Blenkinsop and driver Dennis Rayner were ordered to pay fines and costs totalling £2,800, when they failed to appear before Rochdale magistrates.

Blenkinsop, of Faringdon Row Garage, Deptford, Sunderland, was accused of one offence of using a vehicle without an 0licence, one of exceeding the permitted weight of the compensating axles on Rayner's vehicle, one of exceeding the permitted train weight of the vehicle, and four of failing to ensure Rayner returned tachograph charts within 21 days. He was fined a total of £1,550 and ordered to pay £75 costs.

Prosecuting for the North Western Traffic Area, John Heaton said that the tachograph record charges were specimen offences only — there were 47 such offences. There was no record of Blenkinsop holding an Operator's Licence.

Department of Transport traffic examiner Keith Henry said that when Rayner's 38tonne vehicle was stopped and weighed it was found that the train weight was exceeded by some 4,730kg (12.4%) and the compensating axles were overloaded by 3,510kg (15.6%).
