LC Skips of Redditch had been refused an Operator's Licence by West Midlands LA John Mervyn Pugh because its operating centre was unsuitable. There had been no public inquiry into the application.

Judge Michael Broderick told director Colin Hawkins that the Tribunal had read the appeal papers and it appeared the company's main complaint was that the LA had information the company did not know about and was not given the opportunity to challenge.
