flashing light on a breakdown vehicle but could you say what the Regulations are about its position on the vehicle and when it can be used?
A Regulation 64 of th,e Road Vehicles Lighting Regulations 1971 varies the provisions of Section 21 (1) (b) of the Road Transport Lighting Act 1957 so as to permit distinctive lamps on certain vehicles. Sub-paragraph (1) (b) (ii) of Regulation 64 allows one or more amber lights to be carried on break-down vehicles and sub-paragraphs (2) to (7) indicate the position, shape, size and frequency of the flash.
In short, the light must be not less than 5ft from the ground, the aperture from which light is emitted should be no larger than a rectangle having sides 9in. long, where only one lamp is carried the light should be visible at any point in a circle drawn on a horizontal plane with the lamps as a centre it should be visible not less than 60 or more than 150 times a minute, it should emit a concentrated beam rotating on a horizontal plane and the total Wattage should not exceed 36W.
Sub-paragraph (8) deals with the occasions when the lamp may be used. Briefly, it may be used only when the vehicle is being employed in connection with and is in the immediate vicinity of an accident or break-down or while it is being used to draw a break-down vehicle.
Incidentally, sub-paragraph 65 also allows a break-down vehicle to carry a white light for the purposes of illuminating the scene of an accident or breakdown.
This too, must be fitted not less than 5ft from the ground; it must be used only in the immediate vicinity of an accident or break-down and when the amber light is illuminated; it must be directed so that no person who is driving a vehicle is dazzled by the light emitted; and it may be moved by swivelling or deflecting while the vehicle is in motion in the immediate vicinity of the accident or break-down.
